Terms of Service

These are the terms of the agreement between you and Qualiaverse LLC, a Wyoming limited liability company ("Qualiaverse", "we", "us", or "Notapub") for your use of the Notapub app and website (together, the "Service"). Please read them carefully. By creating an account or otherwise using the Service, you agree to these Terms.

1. Acceptance of these Terms

These Terms are a binding agreement. If you do not agree to them, please do not use the Service. Our Privacy Policy explains how we handle your information and is incorporated into these Terms by reference.

2. What Notapub is

Notapub is a text-first app that helps you reach the right person for what's on your mind: someone who can help with a problem, build on an idea, or has been through something similar. You tell Notapub, in your own words, what you're thinking about and what you'd like to talk about, and the Service quietly surfaces the few people it's relevant to. There are no feeds to scroll, no likes, and no followers.

3. Eligibility

You must be at least 13 years old to use Notapub. If you are under the age of majority where you live, you confirm that a parent or guardian permits your use of the Service. Some content and features are available only to users who are 18 or older. By using the Service, you confirm that you meet these requirements and have the legal capacity (or the required permission) to enter into these Terms.

You also confirm that your use of the Service is lawful where you are: for example, that you are not barred from using it under any applicable law, sanctions list, or court order.

4. Your account and security

You sign in using a phone number or an email address. You are responsible for keeping access to that account secure and for all activity that happens through it. Please keep your sign-in method safe, and tell us promptly at support@notapub.com if you believe someone has used your account without your permission.

You can delete your account at any time from the delete account page.

5. Licence to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Service for your own personal, non-commercial use. This licence does not transfer any ownership to you, and all rights not expressly granted are reserved.

6. Acceptable use

Notapub depends on people treating each other, and the Service, with respect. You agree that you will not:

We may remove content or take other action if we reasonably believe it breaks these rules or puts people at risk.

7. Your content

"Your content" means what you write and share through the Service. As between you and us, your content is yours, and you keep whatever ownership rights you already have in it. You are responsible for what you share, and you confirm that you have the right to share it.

So that we can operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to store and use your content for the limited purpose of providing the Service to you, which includes surfacing relevant parts of it to the few other users it is relevant to. This licence lasts only as long as needed to run the Service and ends when you delete your content or your account, except for copies kept briefly in routine backups or where the law requires us to retain them, as described in the Privacy Policy.

8. Other users

Notapub helps introduce you to other people, but we do not vet or verify the identity, background, statements, or conduct of anyone on the Service. You are responsible for your own decisions about whom to interact with and how, including any decision to communicate or meet in person. Please use good judgement and ordinary caution.

If someone behaves badly, you can report them using the in-app tools or by emailing support@notapub.com.

9. Intellectual property

The Service itself, including the Notapub name, logo, software, text, design, and other materials we provide (but not your content), is owned by Qualiaverse LLC or its licensors and is protected by intellectual property laws. Except for the limited licence to use the Service granted above, these Terms give you no right to copy, modify, distribute, sell, or create derivative works from the Service or its contents.

10. Third-party services

The Service relies on certain third-party providers and may link to or work alongside third-party products and services. We are not responsible for those third parties, and your use of them may be governed by their own terms and policies. App stores through which you obtain Notapub may also impose their own terms, which apply in addition to these.

11. Disclaimers

The Service is provided as is and as available, without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that any person you are introduced to will be suitable or available, or that using the Service will lead to any particular result.

12. Limitation of liability

To the maximum extent permitted by law, Qualiaverse LLC and its officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us, if any, for the Service in the twelve months before the claim arose, or (b) USD 100. Some places do not allow certain limitations, so some of the above may not apply to you; in that case, our liability is limited to the smallest amount the law allows.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Qualiaverse LLC and its officers, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your content, your use of the Service, or your breach of these Terms or of any law or the rights of another person.

14. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, if your use creates a safety, security, or legal risk to others or to us, or if we are required to do so by law. Where it is practical and appropriate, we will let you know.

You may stop using the Service at any time; deleting your account is the cleanest way to end this agreement on your side. Sections that by their nature should survive termination, such as those on your content licence, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will continue to apply after your account ends.

15. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. You and we agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction. If you live somewhere whose consumer-protection laws require disputes to be handled locally or under local law, those rules apply to the extent they conflict with this section.

16. Changes to these Terms

We may update these Terms from time to time. If we make meaningful changes, we will update the Last updated date above and, where appropriate, let you know in the app. Your continued use of the Service after a change takes effect means you accept the updated Terms.
